At Posty Cards® (also referred to as “we”, “us”, and “our” herein), we value your privacy and recognize the confidential and proprietary nature of our customers’ information. This Privacy Policy (“Policy”) will help you understand how we collect and use your information and what we will and will not do with the information we collect. This Policy informs you of our commitment to protect your privacy and respect your choices concerning your personal information. This Policy may change from time-to-time, as further described in the section “Updates to Our Privacy Policy” below.

Scope of Our Privacy Policy

This Policy applies to Posty Cards® and our data collection and processing activities through the Posty Cards® website at https://www.postycards.com/, Print Forest website at https://printforest.com/ (collectively, “Sites”), and our services (“Services”). We encourage you to read this Policy in its entirety before using our Sites or Services. By engaging with one or more of our Sites, using our Services, or making an online purchase with us, you acknowledge and consent that you have read and understand our privacy practices explained in this Policy. If you do not agree with our policies and practices, do not access or use our Sites or Services.

Please note that this Policy does not apply to personal information we collect from our employees or job applicants. Additionally, this Policy does not apply to the collection and use of information by companies that Posty Cards® does not control, nor by individuals not employed or managed by us. If you visit a website that we mention or link to, be sure to review its privacy policy before providing that site with information. We encourage you to review the privacy policies and statements of any website you choose to use or frequent to better understand the way in which websites collect, use, and share your information.

Information We Collect and How

Our Sites are operated in the United States. If you reside outside of the United States, please be aware that any information you provide to us will be transferred to and processed in the United States.

Information that you directly submit to us through our Sites may include:

Standard Identifying Information. Standard identifying information that identifies you, such as your name, business name, billing address, shipping address, mailing address, telephone number, or email address. We will ask you to provide standard identifying information when you submit an order on a Site, customize our Posty Cards® products (“Products”), create an account with us, use one of our Services, sign up for a PostyProTM membership, enroll in, or subscribe, to our mailing lists, contact us with a question or concern, or participate in other activities when you visit our Sites.

Account Information. When you create an account, we will collect your name, business name, mailing address, billing address, email address, phone number, account login and password, and corporate group (if applicable).

Shopping Information. When you shop on our Sites, we collect information about search queries, viewing history, and Products or Services added to your cart or saved with your account.

Purchase Transaction Information. We collect details about your transactions conducted through our Sites and of the fulfillment of your orders, including name, personalization details, return address, payment confirmation, email address, delivery information (e.g., billing, shipping, and delivery addresses) that you provide when you purchase our Products or Services. Your payment card information is encrypted and transmitted to us using a secure internet connection.

Customer Support Information. When you have an inquiry or engage with our customer support team, we collect information necessary to allow us to assist you, such as your name, contact information, order history, and communications you choose to share with us.

Personalization Information. When you customize and personalize Products on our Sites, we collect your, or your business’s, name, image, likeness, trademarks, logos, written content, and other information used to customize or personalize our Products.

Contact Lists. When you sign up for a PostyPro™ membership plan for scheduled and managed mailing services, you may submit contact lists or mailing lists of your family members, friends, employees, clients, or customers (collectively, “Contact Lists”) to us in connection with these Services. You may submit contact lists or mailing lists of your family members, friends, employees, clients, or customers (collectively, “Contact Lists”) to us in connection with Standard Plan Services. Please note that we only use information from your Contact Lists to perform the Services included in your PostyProTM membership plan and/or Standard Plan services.. We do not use information from your Contact Lists for marketing and will not solicit your contacts for our own purposes.

Reviews. When you submit reviews, testimonials, and other user-generated content (collectively, “Reviews”) through our Sites or social media, this content will become public and accessible by anyone. We may use or share your Reviews on our Sites or social media accounts to promote our Products and Services. Please note that we do not control who will have access to your Reviews when you post it on third-party sites and cannot ensure that third parties will be responsible for maintaining the security or accuracy of your Reviews.

Sensitive Personal Information. There may be instances when information you provide to personalize your order or pay for your purchase qualifies as sensitive personal information. The definition of “sensitive personal information” depends on where you live and applicable privacy laws. Examples of sensitive personal information include payment card information, religious beliefs, ethnicity, and trade union membership. We only process sensitive personal information that you share with us for the purposes of (i) creating and maintaining your account and PostyProTM membership; (ii) fulfilling your orders for our Products and Services; (iii) processing your payment for our Products or Services; and (iv) carrying out our legal obligations or exercising specific rights as permitted by law.

Information from Your Device. When you visit our Sites or use our Services, information about the device or browser you use may be shared with us, including IP address, mobile carrier, telephone number, browser type and language, operating system, and location (if enabled on your device). We may also determine what technology is available through your browser to serve you the most appropriate version of our Sites.

Usage Data. We may also collect information about how your device or browser interacts with our Sites, such as the content you access, pages visited before and after you reach the Products and Services offered through our Sites, the date and time of your use, the amount of time spent on our Sites, and other actions taken through use of our Sites. We use data analytics with this usage data to better understand your use of our Sites in order to improve our Sites, Products, and Services offered. Internet or Other Network Activity. We collect information about your internet activity, including browsing or search history, interactions with our Sites, or marketing and advertising. We collect information from Google Analytics, social media analytics, or other third-party data aggregators; we may use such information to supplement your information maintained by us. Social Media. If you access our Sites through third-party social media sites such as TikTok, Instagram, X formerly known as Twitter, or Facebook, we may collect information about you from that third-party social media site, including information you have made public via your privacy settings, such as your profile name or social media handle, profile picture, and your social media contacts or friends.

Information We Learn. Please be mindful of the fact that by the nature of your viewing, personalization, and Product selection, we may passively learn information about your hobbies and interests, religion, holidays you celebrate, ethnicity, and language(s) you speak. For example, when you browse and order Christmas cards and add a religious verse. We may also passively learn information about your employment, education, occupation, and profession. We do not use this type of information to make inferences about you for marketing purposes.

Why We Use Your Information

We use your information for the following purposes:

  • Allow you to access and use our Sites.
  • Provide you with our Services.
  • Creation and maintenance of your account or PostyProTM membership plan.
  • Process and fulfill your orders submitted through our Sites.
  • To communicate with you and provide customer support.
  • To send you marketing materials and/or promotions when you subscribe to our mailing list or sign up for our PostyProTM membership or other programs.
  • For analytics, research, and improvement purposes of our Sites, Products, and Services.
  • For analytics and advertising purposes.
  • To ensure the security and integrity of our Sites and Services.
  • To comply with any applicable law and/or regulations and our contractual obligations.
  • For safeguarding and defending our vital interests and exercising any rights, asserting any claims, and any other lawful business purpose.

Access to our Sites, Products, and Services. Posty Cards® uses your information to operate, improve, maintain, and personalize our Sites and provide you with our Products and Services.

Account Access and Maintenance. We store and access your account information to process your order and provide you with a convenient user experience, including eliminating the need for you to re-enter the information each time you order. To protect your information, you will be required to enter a valid login name and password before making a purchase on your existing account.

Processing and Fulfillment. Posty Cards® uses your information to process and fulfill your orders and requests submitted through our Sites, including purchases, customization, and personalization of our Products and Services.

Communication and Support. Posty Cards® uses your information to communicate with you and provide support when you request it. See the “Communications With You” section below for more information. We may also use this information to train our employees to provide customer support services in connection with future requests.

Text Messages. As a security feature, we may confirm your identity by sending an automated code or pin to your phone number via text message before we process your transactions or fulfill a request.

Marketing and Promotions. With your consent, Posty Cards® uses your information to market its Products and Services, which may include contacting you by phone, email, and postal mail with information about news, offers, Products, promotions, events, and/or Services that might be of interest to you, as permitted by applicable law. We may also use your mailing address to send you catalogs with our Products and Services. Analytics, Research, and Development. Posty Cards® is continuously trying to improve our Sites, Products, and Services as well as your experience. We may use your information for these business purposes, including:

  • Monitoring and measuring your use of our Sites, Products, and Services and conducting research to understand how they are being used and how they can be improved. Posty Cards® uses analytic tools and programs to perform these functions, including, but not limited to, Google Analytics and social media analytics.
  • In some cases, information may be anonymized, compiled, and analyzed on an aggregated basis. We may share this aggregate data with our service providers, distributors, and other third parties with whom we do business. Examples include, but is not limited to, usage, performance, and purchase history. This aggregated information does not identify you personally.

Analytics for Advertising. We use information from your browser or device and analytic tools to serve you with Posty Cards® advertising on third party social media platforms and sites. For example, we use analytic tools to understand and measure the effectiveness of our ads displayed on Facebook and other social media.

Security and Integrity of Our Sites. Providing a safe and secure environment is key to providing a responsible website and we do this by using your information to:

  • Authenticate and verify your identity;
  • Detect and combat any harmful activity, abuse, fraud, spam, and illegal activity affecting our Sites, Products, Services, and related operations;
  • Monitor content on our Sites; and
  • Prevention and detection of crime.

Compliance. We may use your information to investigate disputes or claims related to our Sites, Products, and Services. In certain circumstances, we may be obligated to use your information to respond to legal, government, or regulatory requests and comply with our obligations under applicable laws and regulations. We may use the IP address associated with your device to determine your general location in order to comply with governing privacy regulations and serve you necessary notifications and/or consent mechanisms.

Contractual Obligations. We use your information to fulfill your Product orders and perform the Services you purchased or requested. We may also use your information in the performance of our contractual obligations with service providers we contract with to provide you certain Services in connection with your use of our Sites and processing your orders, including mail couriers and carriers like FedEx, UPS, and the United States Postal Service and our payment card processors, such as Stripe and Authorize.net.

Protecting Vital Interests, Rights, and Lawful Business Purposes. From time-to-time, we may use information for safeguarding and defending our vital interests, exercising any rights we may have under law or contract, asserting any claims or defenses, and for any other lawful business purpose. This includes any incidental business purpose related to or in connection with any of the above, or for any other purpose disclosed to you at the point at which we collect your personal information.

Who We Share Your Information With

We do not sell your personal information as the term sell is commonly understood. We do not use your personal information for the purpose of inferring characteristics about you. However, we may share your personal information to the following categories of recipients for the purposes described in this Policy, and these may be considered a “sale” or “sharing” under certain privacy laws.

Service Providers. Posty Cards® may share personal information with trusted service providers, such as technology partners, web developers, analytics providers, cloud storage providers, or other providers that need access to your information to provide operational or other support services while you use our Sites. Such service providers include, but are not limited to, Amazon web services, CloudFlare, Microsoft, Google Analytics, Bing Analytics, Vimeo, and other social media analytic providers.

Business Partners. Posty Cards® may share personal information with our business partners who otherwise process personal information for purposes described in this Policy, such as hosting our Sites, processing and fulfillment of orders; addressing, mailing, and delivery services; advertising and marketing partners; research partners and consultants; or others who are disclosed to you when we collect your personal information. Such business partners include, but are not limited to, Stripe, Authorize.net, FedEx, UPS, United States Postal Service, MailChimp, Mailgun, Google and Google Analytics, Bing Analytics, and other social media analytic providers.

Social Media Companies. We may contract with social media companies to display ads on their service, such as Facebook and Instagram. These companies may use Cookies and similar technologies to track your activity. The information collected by these social media companies in this manner is subject to their own privacy policies.

Government Agencies, Regulators, Law Enforcement, and Courts. We may share your personal information with competent law enforcement bodies, regulators, our insurers, outside legal advisors, government agencies, courts, or other third parties where we believe disclosure is necessary to: (i) comply with applicable law; (ii) exercise, establish or defend our legal rights; (iii) protect our rights or vital interests as well as those of any other person; or (iv) detect, prevent, or otherwise address security, fraud, or technical issues.

Potential Buyers (and their agents and advisors). We may share your personal information with actual or potential buyers (and their agents and advisors) in connection with any actual or proposed purchase, merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of Posty Cards® or our assets, or the transition of Services to another provider. In such a case, we will inform the buyer or transferee that it must use your personal information only for the purposes disclosed in this Policy.

Aggregated Data. We may disclose information that has been aggregated or does not identify any individual or device without any restrictions or limitations.

Communications With You

Posty Cards® may contact you at any phone number or email address that you have provided us, to: (i) verify your identity, including your phone number, email address, or other contact information; (ii) confirm or cancel your order; (iii) verify information to process your order such as billing, shipping, delivery, or return address; (iv) notify you regarding your account, PostyProTM membership, or order; (v) send you news and updates about our Sites, PostyProTM membership, or your account; (vi) troubleshoot problems with your account, PostyProTM membership, or order; (vii) resolve a dispute; (viii) collect a debt if you purchase our Products or Services; (ix) poll your opinions through surveys or questionnaires; (x) service your account or PostyProTM membership; and/or (xi) enforce our Terms and Conditions, our Return Policy, and other rules, guidelines, policies, applicable law, or any other agreement we may have with you.

As a valued Posty Cards® customer, we will notify you via email (including autogenerated email messaging through MailChimp or other service provider) or through the mail about new Products, Services, and special money-saving offers. You can opt out of receiving these offers at any time by emailing us at customerservice@postycards.com or by clicking on the unsubscribe link in our promotional emails.

Posty Cards® may monitor or record phone conversations you, or anyone acting on your behalf, has with Posty Cards® or its agents for quality control and training purposes, or for its own protection.

Our automated systems may scan and analyze the contents of every message sent through the messages platform on our Sites to detect and prevent spam, phishing, fraudulent activity, or violations of our Terms and Conditions, including the incorporated terms, notices, rules, and policies. This may result in a manual review of messages sent through our messaging tools. This scanning and analysis may occur before, during, or after the message is sent, or while in storage, and may result in your message being delayed or withheld. Posty Cards® may store message contents, including to conduct this scanning and analysis.

Cookies

Like many websites, we use cookies, pixels, and other tracking tools and technologies for functionality and analytics (collectively, “Cookies”) on our Sites. We use Cookies to remember your settings between sessions, keep track of advertisements, and to compile aggregate data about Site traffic and Site interaction, all of which allow us to offer you a better Site experience and tools in the future. We contract with third-party service providers to assist us in better understanding our Site visitors. We also use Cookies to gather information on how users interact with our ads located on social media, such as Facebook.

Depending on your device or search engine, you can choose to have your computer warn you each time a Cookie is being sent, or you may be able to turn off all Cookies via your browser settings. Like most websites, if you turn your Cookies off, some of our Services may not function properly. Privacy of Minors

While many of our Products are perfect to send to minors, our Sites, Products, and Services are not intended for use by minors. No one under the age of 18 may provide any personal information on our Sites. We do not knowingly collect personal information from minors under 18. If you are under 18, do not (1) use or provide any information on our Sites, or through any of the features/functionality of our Sites; (2) use any of the interactive, transmittal, or public comment features that may be available on our Sites; or (3) provide any information about yourself to us, including your name, address, telephone number, e-mail address, or any screen name or username you may use. If we discover that information about a minor under the age of 18 has been inadvertently collected, we will take the necessary steps to ensure that such information is deleted from our system’s database, or in the alternative, that consent from a parent or legal guardian is obtained for the use and storage of such information.

How to Request Information

Posty Cards® respects your privacy rights and choices. In some instances, we request your consent before we collect certain information about you. Depending on where you live and whether you are using our Sites and Services for business purposes (e.g., in a commercial transaction or other B2B setting) or personal reasons, you may have certain privacy rights established by law.

Your request must include your full name, mailing address, city, state or province, postal code, and an email address so we can locate your record and contact you about your request, as needed.

We will confirm your identity and authorization before acting on your requests. We may not be able to respond to your request or provide you with personal information if we cannot verify your identity or the authority to make the request on someone else’s behalf.

Once your request is processed, absent any exceptions under applicable law, we will provide you with details regarding what personal information we have, how it is used, and with which third parties it is shared.

How to Unsubscribe to Direct Marketing

We may send marketing communications for purposes disclosed to you in this Policy and, where required by applicable law, with your consent. You can unsubscribe from direct marketing at any time by following the unsubscribe instructions included in the electronic message or by contacting us using the details provided under the “Contact Posty Cards®” section. We will process your request within a reasonable time after receipt, in accordance with applicable laws.

Data Retention

Posty Cards® retains personal information we collect or receive as described in this Policy for the purposes for which it was collected and to provide our Sites, Products, and Services to you, communicate with you, training of employees, establish legal defenses, conduct audits, research and development of new Products and Services, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws. For example, we keep your standard identifying information and account credentials as long as you maintain a Posty Cards® account or PostyProTM membership. We also keep your billing and shipping information for processing returns during the return period.

To determine the appropriate retention period for your personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of your information, the purposes for which we process your information, and the applicable legal requirements. When we no longer need your personal information for a business purpose, or are no longer required to retain the personal information as described above, we will destroy, erase, or anonymize it. However, legal requirements (such as record retention requirements or litigation holds) may require us to retain some or all of the personal information we hold for a longer period of time even after our business purpose or need expires.

Security

At Posty Cards®, we recognize that the information you share with us is often confidential and proprietary in nature. We strive to maintain secure Sites and offer you a secure shopping experience. Your payment card information is encrypted and transmitted to us using a secure internet connection. We take reasonable steps to protect your information from unauthorized use and access. Although we do our best to protect your personal information, we cannot guarantee 100% security of your personal information transmitted through our Sites or in connection with our Services.

The safety and security of your information also depends on you. It is important to keep your account log-in and password confidential. We ask you not to share your password with anyone.

Third Party Links and Services

Links. For convenience or when we think it beneficial to our customers, our Sites may provide links to other websites or content not owned by us. We do not control and are not responsible for the privacy practices used by other website owners or the content or accuracy of those other websites. Links to various third-party websites or pages do not constitute or imply endorsement by us of these websites or pages, or any products or services described on these other websites or pages.

Social Media Integration. Our Sites may contain links to and from social media platforms. On occasion, you may choose to connect to us through a social media platform, such as Facebook, X formerly known as Twitter, Instagram, TikTok, Google, etc. When you do, we may collect additional information from or about you, such as your screen names, profile picture, social media handle, contact information, contact list, and the profile pictures of your contacts, through the social media platform. Please be advised that social media platforms may also collect information from you. When you click on a social plug-in, such as Facebook’s “Like” button, that particular social network’s plugin could be activated and your browser may directly connect to that provider’s servers. We do not have control over the collection, use, or sharing practices of social media platforms. We encourage you to review their usage and disclosure policies and practices, including their data security practices, before using the social media platforms.

Third Party Information Collection. When you use our Sites, certain third parties may use Cookies and other automatic information collection technologies to collect information about you or your device. This may depend on the device or browser that you use to access our Sites. These third parties may include:

  • Advertisers, ad networks, and ad servers.
  • Analytics companies.
  • Your mobile device manufacturer.
  • Your mobile service provider.
  • Third parties that you have authorized to monitor your activities.

These third parties may collect information about your online activities over time and across different websites, apps, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
